Big changes are coming! Effective June 30, 2019, the NJFLA will cover employers with 30 or more employees. Current law applies only to employers of 50 or more workers. Remember, all workers – not just those located in New Jersey – must be counted, although only those working in the Garden State are entitled to NJFLA leave.
The definition of “family member” has been expanded to include a child of any age (including a foster child or a child born through a gestational carrier), parent, parent-in-law, sibling, grandparent, grandchild, spouse, domestic partner, partner in a civil union, any other individual related by blood to the employee and any other individual with whom an employee has a close association equivalent to a family relationship.
In addition, employers must now allow employees to take baby bonding leave intermittently; under prior law, intermittent leave to care for a new child was available only if the employer agreed. Employees must give 15 days’ notice of their intention to take intermittent leave.
Make sure you have put up the new NJFLA poster, available here.
