That’s what the Red Queen told Alice at the beginning of Through the Looking Glass. You may feel like that sometimes, when you consider keeping up with changing requirements for posters and forms.
The Equal Employment Opportunity Commission and the New Jersey Division on Civil Rights issued new mandatory posters last fall. And the EEOC is expected to update its poster again soon, to include the 2022 Pregnant Workers Fairness Act.
In April, 2023, the federal Department of Labor put out two new posters. First, there is now a revised WH-1420, the Family and Medical Leave Act (FMLA) poster. While the previous version of the FMLA poster still meets the posting requirement, best practice is to post (physically/electronically) the current one as soon as practicable.
Second, the DOL put out a revised Fair Labor Standards Act (FLSA) poster (WH-1088) to include the 2022 Providing Urgent Maternal Protections for Nursing Mothers (PUMP) Act. Unlike the FMLA poster, employers must immediately replace the older FLSA poster. Old versions of the FLSA poster are no longer compliant.
For federal contractors, there is a new Voluntary Self-Identification of Disability Form (CC-305) from the Office of Federal Contract Compliance Programs. This form, which has updated and expanded examples of disabilities, can be used with applicants and employees right now, but must be used starting July 25, 2023.
